DECISION
Adjudicator: Naomi Overend
Date: October 31, 2016
Citation: 2016 HRTO 1405
Indexed as: Bajwa v. Ontario (Community Safety and Correctional Services)
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on June 13, 2016.
2On September 19, 2016, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the Application appears to be outside the Tribunal’s power to decide. The applicant was directed to respond to the issues raised in the NOID by no later than October 19, 2016. The NOID was sent by mail at the address contained in the Application.
3The letter containing the NOID was returned to the Tribunal as the applicant no longer resides at that address. The applicant did not provide alternative contact information in his Application and has not notified the Tribunal of any change in his contact information, as he is required to do under Rule 1.13 of the Tribunal’s Rules of Procedure.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 31st day of October, 2016.
