Introduction
1The applicants filed Applications under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on July 7, 2015.
2On September 14, 2015, the Tribunal issued a Deferral of Applications, deferring the Applications pursuant to Rule 14 of the Rules of Procedure pending the completion of Landlord and Tenant Board (“LTB”) proceedings.
3On August 19, 2016, the Tribunal issued a letter requiring the applicants to advise the Tribunal of the status of the LTB proceedings within 30 days of the date of the letter. The Tribunal warned that failure to do so may lead to a dismissal of the Applications as abandoned. The letter was sent by mail.
4On October 5, 2016, the Tribunal sent an email to the applicants extending the deadline to advise the Tribunal of the status of the LTB proceedings by October 18, 2016.
5The applicants have not responded to the requests for a status update, the time for doing so has now passed and the requests for status update have not been returned as undeliverable.
6In the circumstances, the applicants are deemed to have abandoned the Applications.
7The Applications are dismissed.
