1This Application under the Human Rights Code, R.S.O. 1990, c.H.19, as amended (the "Code") is scheduled for a hearing on November 1 & 2, 2016 in Sarnia.
2The Tribunal sent the parties the Notice of Hearing on July 19, 2016 advising them that they were to comply with their obligations respecting filing of documents and witness statements under Rules 16 and 17 of the Tribunal's Rules of Procedure by September 19, 2016.
3As the applicant did not file any documents, the Tribunal issued a Case Assessment Direction ("CAD") on October 6, 2016, requiring the applicant to comply with the Rules no later than October 13, 2016. The CAD warned that there were serious consequences for failure to comply with the rules, and specifically stated:
If the applicant has not complied with these directions by October 13, 2016, or communicated with the Tribunal at all, the Application may be dismissed as abandoned.
4It is now past the deadline given in the CAD, and the applicant has not filed any materials with the Tribunal under the above Rules, nor has he otherwise communicated with the Tribunal. The CAD was sent to the last address provided by the applicant, and has not been returned as undeliverable.
5In the circumstances, it appears that the applicant has abandoned the Application.
ORDER
6The Application is dismissed as abandoned and the November 1 & 2, 2016 hearing dates are cancelled.
