WRITTEN SUBMISSIONS
Mohamed Chaarani, Applicant Self-represented
Islamic Society of Guelph and Muhammad Sharif, Respondents Donald Kidd, Counsel
Introduction
1This Application alleges discrimination with respect to membership in a vocational association because of race contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On September 13, 2016, the applicant filed a Form 10 Request for Order During Proceedings (Request) to amend his Application. On the Request, he indicated that he wanted to add discrimination to the Application. No further reasons for the Request were provided. There were two documents attached to the Request. These two documents were referenced in the Application.
3The respondent submits that the Request should be refused as the applicant has already alleged discrimination in the Application so the amendment is not necessary. The respondent further submits that the applicant can rely on the documents he has attached in any event.
4The Tribunal agrees with the respondent. The amendments are not necessary. The documents that are attached to the Request can be disclosed to the respondent and filed with the Tribunal under Rule 16 of the Tribunal’s Rules of Procedure. The steps for compliance with Rule 16 would be set out in a Notice of Hearing if necessary.
5The applicant may wish to review the documents available on the Tribunal’s website under the section “Application and Hearing Process” at http://www.sjto.gov.on.ca/hrto/application-and-hearing-process/.
ORDER
6The applicants Request to Amend the Application is denied.
7I am not seized.
