1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on June 14, 2016, alleging discrimination with respect to the provision of goods, services and facilities on the basis of race, colour and gender identity.
2On August 25, 2016 the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) because it appears the Application is outside the Tribunal jurisdiction. More particularly, the Application challenges the decision or outcome of an adjudicative process.
3The applicant was directed to file written submissions responding to the issues identified above by September 26, 2016 and warned that the Tribunal may consider a failure to respond as an abandonment of the Application and dismiss it for that reason.
4The applicant has not responded to the NOID, the time for doing so has now passed and the NOID has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
