2A Notice of Hearing was sent to the parties on May 24, 2016. The Notice set dates for disclosure and production of documents pursuant to the Tribunal’s Rules of Procedure. The Notice of Hearing directed the parties that by August 23, 2016 they were to deliver witness statements, the list of the documents they intend to rely on and a copy of those documents to the other party and then file copies of all of these documents with a completed Statement of Delivery (Form 23) with the Tribunal.
3The Tribunal granted the parties an extension of time to serve and file their witness statements and documents until September 26, 2016.
4The respondent has served and filed its witness statements and the documents that it intends to rely on at the hearing.
5The applicant has not filed any of the required documents to date.
6Given the fact that the applicant has not complied with any of his disclosure requirements as outlined in Rules 16 and 17 of the Tribunal’s Rules of Procedure and has not communicated with the Tribunal or the respondent since September 9, 2016, the Application is dismissed as abandoned.
