1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, on November 3, 2015.
2On August 25, 2016, the Tribunal sent an e-mail message to the applicant directing him to confirm by August 29, 2016 whether he was available for mediation on dates proposed by the respondent. The applicant did not respond. On September 7, 2016, the Tribunal sent an e-mail directing him to confirm, by the end of the day, whether he was available for mediation on the dates proposed by the respondent. Again, the applicant did not respond.
3By letter dated September 8, 2016, the Tribunal directed that the applicant confirm his intentions regarding the Application. This letter indicated that if the applicant wished to proceed with the Application, he must respond to the Tribunal’s e-mail message of August 25, 2016 and provide the dates on which he was available for mediation in November and December 2016. In the letter, the Tribunal warned the applicant that he did not respond to the letter by September 19, 2016, the Tribunal may dismiss the Application as abandoned.
4To date, the applicant has not responded to any of the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
