1This Application is scheduled to reconvene on October 7, 2016. This Interim Decision concerns issues that have been raised by the parties in advance of this hearing.
Allegations relating to earlier grievances
2An Interim Decision dated June 3, 2016, addressed the applicant’s suggestion that there are allegations about human rights issues that were raised in earlier grievances which were not resolved or otherwise dealt with and that relate to some of the Applications she has filed with this Tribunal. The Interim Decision provided as follows:
As discussed at the hearing, if the applicant wishes to pursue these matters, she must do the following:
Identify what grievances she believes have not been resolved and what allegations they relate to.
Identify the Application to which these allegations relate and where in those Applications the unresolved issues were identified as human rights issues.
Identify what remedy the applicant seeks in relation to these issues.
3In a subsequent Case Assessment Direction, I noted that the applicant had sent a large number of documents relating to various grievances. However, the applicant had not identified what allegations they relate to or which Application they may relate to. She had not identified what the unresolved human rights issues may be or any remedy she is seeking in relation to those issues.
4I stated that without this clarifying information, the respondents cannot reasonably be expected to respond to the collection of documents, especially since some go back a number of years. I directed that if the applicant wishes to pursue these matters she must follow the direction in the Interim Decision.
5I directed that she must do so by August 2, 2016, and if she had not done so by that date, allegations related to past grievances may be dismissed.
6The applicant has provided a list of grievances but no particulars and none of the information that she was directed to provide.
7In the circumstances, the allegations related to past grievances are dismissed and will not be dealt with at the hearing on October 7, 2016.
Request from the applicant for disclosure of documents
8On September 23, 2016, the applicant sent a Request for Order During Proceedings to the Tribunal. The Registrar was not able to open the document and advised the applicant to re-send it in a different format. The applicant has not yet done this. The respondent filed a Response to the applicant’s Request for Order During Proceedings. It indicates that the applicant’s request was a request for disclosure of more documents. The respondent objects to the request as it does not believe that the requested documents are relevant and because the request has only arisen late in the process.
9Since the Tribunal has not yet received the applicant’s request, I do not know what the documents are. I cannot therefore make a ruling on the request. In the circumstances, this matter can be raised at the hearing.
Direction about the hearing
10In the previous Interim Decision, I noted that there was discussion about whether the hearing should be scheduled as an in-person hearing or as a telephone conference call hearing. At that time, I directed that an in-person hearing be scheduled. However, in light of subsequent developments, including the uncertainty about the issue of additional documents, I find that it is more efficient and expeditious to convert the hearing scheduled for October 7, 2016 to a telephone conference call hearing.
11The Registrar will send call-in information to the parties.
