1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleged discrimination in contracts on the basis of race.
2On August 11, 2016 a Notice of Mediation was sent to the parties.
3On September 1, 2016 the Tribunal wrote to the applicant to advise that the Notice of Mediation was returned to the Tribunal marked “Moved/unknown” and “Return to Sender”/ The applicant was directed to provide a current mailing address by September 15, 2016 failing which the mediation would be cancelled and the Application may be dismissed as abandoned. .
4The September 1, 2016 letter was returned to the Tribunal marked “Moved”.
5The applicant did not provide the Tribunal with an email address.
6As the Tribunal advised the applicant in its September 1, 2016 letter the Tribunal’s Rules provide as follows:
5.4 The Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided to the Tribunal by that person.
7In the circumstances it appears that the applicant has abandoned his Application and it is dismissed.
