1These Applications are scheduled to be heard in Toronto on September 14, 2016.

2On September 12, 2016, the parties filed a Form 25 Confirmation of Settlement for Application 2015-23519-I, E.J. v. Toronto District School Board and Toronto Student Transportation Group.

3In addition, the applicant C.J., through her litigation guardian, filed a Request for Order During Proceedings (“Request”) that Application 2015-23579-I, C.J. by her litigation guardian E.J. v. Toronto District School Board and Toronto Student Transportation Group, be stayed for one year from September 14, 2016, pending the outcome of a family court proceeding. This proceeding may determine whether E.J. has the right to continue to act as C.J.’s litigation guardian in this Application. The respondents consent to the Request.

4The parties agree that should E.J. regain the right to act as C.J.’s litigation guardian in Application 2015-23579-I., C.J. will file a Request to withdraw that Application.

5The parties have made a request that I make an Order stating that should E.J. not gain the right to act as C.J.’s litigation guardian in Application 2015-23579-I, that this Application be dismissed as abandoned. I have decided not to include this as part of this Interim Order as C.J., through another litigation guardian, may determine that she wishes to pursue this Application and request that this Stay be lifted.

6If no party communicates with the Tribunal by September 14, 2017, the Application may be dismissed as abandoned.

Order

7The hearing scheduled for September 14, 2016, on files 2015-23519-I and 2015-23579-I is cancelled.

8Application 2015-23519-I, E.J. v. Toronto District School Board and Toronto Student Transportation Group, will be closed by the Tribunal and an administrative letter to confirm this closure will be sent to the parties.

9Application 2015-23579-I, C.J. by her litigation guardian E.J. v. Toronto District School Board and Toronto Student Transportation Group, is stayed for one year from September 14, 2016.
