1This Application alleges discrimination with respect to membership in a vocational association because of creed contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The respondent has filed a Response denying the allegations against it.
3The matter is in the queue to be scheduled for hearing.
4The applicant has filed a Request for an Order During Proceedings (“RFOP”) in which he seeks to amend the social ground upon which his Application is based from “membership in a vocational association” to “goods, services and facilities”.
5The respondent has not filed a Response to the RFOP and the time for doing so has elapsed.
Analysis
6The Tribunal has the jurisdiction to amend an application under Rule 1.7(c) of the Tribunal’s Rules of Procedure. Some factors the Tribunal considers in deciding to exercise this discretion are the nature of the proposed amendments, the reasons for requesting the amendments, the timing of the request to amend, and the prejudice to the respondent. See, for example, Wozenilek v. 7-Eleven Canada Inc., 2009 HRTO 926.
7In this case, the applicant seeks to amend the social ground, the matter has not yet been scheduled for hearing, and the respondent has not filed a Response to the RFOP.
8Accordingly, the applicant’s request to amend his Application is granted and the social ground in his Application is amended to “goods, services and facilities”.
9I am not seized with this matter.
