DECISION
Adjudicator: Josée Bouchard
Date: January 25, 2016
Citation: 2016 HRTO 117
Indexed as: Mattingly v. Ontario (Community Safety and Correctional Services)
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on September 22, 2014, alleging discrimination in employment because of disability.
2In its Interim Decision the Tribunal deferred proceeding with this Application pending the completion of related grievance proceedings.
3On October 14, 2015, the Tribunal wrote to the applicant seeking the status of the grievance proceedings and, if possible, an expected completion date. The applicant was warned that failure to respond to the letter within 30 days might result in the Tribunal dismissing the Application as abandoned.
4The applicant did not respond. The Tribunal’s letter has not been returned as undeliverable.
5On January 4, 2016, the Tribunal emailed the applicant again requesting information about the status of the grievance proceedings and warning her that failure to provide this information by January 11, 2016 might result in the Tribunal dismissing the Application as abandoned.
6The applicant has not responded to the Tribunal’s email. The Tribunal’s email to the applicant has not been returned as undeliverable.
7In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 25th day of January, 2016.
