1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Application was deferred on February 6, 2015 pending the completion of a related grievance.
2On October 29, 2015 the Tribunal wrote to the parties seeking an update on the status of the grievance. The letter stated that applicant was required to inform the Registrar in writing within 30 days of the date of the letter whether the grievance remained ongoing and, if possible, to indicate when it was expected to be completed. The letter further stated that if he failed to respond, he may be considered to have abandoned his Application and it might be dismissed for that reason. As the applicant had not responded within 30 days, a further letter was sent to the applicant on December 2, 2015 requiring the Applicant to provide the requested information respecting the status of the grievance by December 16, 2015.
3The applicant has not responded to the Tribunal’s October 29, 2015 or December 2, 2015 letters. The Tribunal’s letters to the applicant have not been returned as undeliverable.
4In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
