Human Rights Tribunal of Ontario
BETWEEN:
Stephen Kadolph Applicant
-and-
SAP Canada Inc. Respondent
DECISION
Adjudicator: Douglas Sanderson Date: August 24, 2016 Citation: 2016 HRTO 1125 Indexed as: Kadolph v. SAP Canada Inc.
1This Application, filed under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, alleges discrimination with respect employment because of disability.
2The parties participated in mediation on June 8, 2016. The mediator reported that the parties reached a settlement and that the Settlement Form (Form 25) would be filed within two weeks of the date of settlement. By letter dated July 28, 2016, the Tribunal advised the parties that its records indicate that the parties have settled the matter, but have not yet filed a Form 25 confirming the settlement. The Tribunal directed the parties to file a completed Form 25 by August 11, 2016, in order that the Tribunal may close the file on the basis of the settlement. The Tribunal advised that if it did receive a completed Form 25 or confirmation that the applicant intends to proceed with the hearing by August 11, 2016, then it may deem the Application to be abandoned and dismiss it on that basis.
3As of the date of this Decision the Tribunal has received neither a Form 25 completed by the parties nor confirmation that the applicant intends to proceed with the Application. In the circumstances, it appears the Application has been abandoned.
4The Application is dismissed.
Dated at Toronto, this 24th day of August, 2016.
