## Introduction
[1] The applicant filed an Application under [s. 34](https://www.canlii.org/en/on/laws/stat/rso-1990-c-h19/latest/rso-1990-c-h19.html#sec34_smooth) of the [Human Rights Code](https://www.canlii.org/en/on/laws/stat/rso-1990-c-h19/latest/rso-1990-c-h19.html), R.S.O. 1990, c. H.19, as amended (the “Code”), on November 18, 2015.
[2] On December 10, 2015, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the application appears to be outside the Tribunal’s power to decide. More particularly, the Application fails to identify specific acts of discrimination connected, in whole or in part, to one of the grounds set out in Part I of the [Code](https://www.canlii.org/en/on/laws/stat/rso-1990-c-h19/latest/rso-1990-c-h19.html) (e.g. race, disability, sex). In addition, the Application alleges “reprisal or threat of reprisal”, but fails to explain how the respondent’s behaviour was related to claiming or enforcing a right under the Code, instituting or participating in proceedings under the Code, or refusing to infringe the right of another person under the Code.
[3] The applicant was directed to respond to the NOID by January 9, 2016 and warned that failure to respond may be considered an abandonment of the Application and it might be dismissed for that reason.
[4] The applicant has not responded to the NOID and the time for doing so has now passed.
[5] In the circumstances, the applicant is deemed to have abandoned the Application.
[6] The Application is dismissed.
