Introduction

1This Application alleges discrimination with respect to employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").

2This Interim Decision addresses the issue of whether the Tribunal should defer consideration of the Application pending the completion of a grievance.

3The parties have filed responses to the Notice of Intent to Defer.

4The applicant indicated that on the advice of her union the grievance has been withdrawn.

5Since it appears that the grievance has been withdrawn, it is not appropriate to defer this Application.

ORDER

6For the reasons set out above, the Application shall proceed.

7Since the Response has not yet been filed, the respondent shall serve and file its Response within 35 days of the date it receives this Interim Decision.
