BETWEEN:
A.B. Applicant

The Corporation of the City of Brampton Respondent
INTERIM DECISION
Adjudicator: Laurie Letheren Date: January 22, 2016 Citation: 2016 HRTO 105 Indexed as: A.B. v. Brampton (City)
APPEARANCES
A.B., Applicant Jean-Alexandre De Bousquet, Counsel
The Corporation of the City of Brampton, Respondent Susan Crawford, Counsel
Introduction
1Interim Decision, 2016 HRTO 46, issued January 12, 2016, denied the applicant’s request that he be provided with anonymity in the Tribunal process.
2Since the time of issuing this Interim Decision, new circumstances have been revealed and the parties have jointly requested that I anonymize the name of the applicant.
3The Tribunal’s Practice Direction on Anonymization of HRTO Decisions (Effective April 2014) provides that the Tribunal may anonymize the name of a party to protect the confidentiality of personal or sensitive information where it is appropriate to do so; however, such an order is only made in exceptional circumstances. When determining whether to make an anonymization order, the Tribunal’s general approach is to balance the public interest in freedom of expression and open justice against any significant consequences of identifying the person requesting anonymization. The Tribunal has granted requests for anonymization where there is highly sensitive medical information or particularly sensitive information related to an acute mental health crisis.
4In light of the newly developed circumstances, I am exercising my discretion to anonymize the name of the applicant in this Application.
ORDER
5The name of the applicant will be anonymized in this decision and the decisions previously released by the Tribunal in this Application. The applicant will be noted as A.B. in the decisions.
Dated at Toronto, this 21st day of January, 2016.
