1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The applicant is represented in the workplace by Unifor Local 27 ("the union").

2On its Response, the respondent marked off that it was requesting the Tribunal to defer the Application because of a grievance that was filed with the union. The respondent did not provide a copy of the grievance or provide any details about when the grievance was filed or what it was about.
3The Tribunal directed the applicant, in its June 17, 2016 correspondence sending her the Response, to address the issue of deferral.
4The applicant filed a Reply. In it, she submitted that she did not file a grievance and claimed that she did not have support from her union to do so.
5The Tribunal will not defer this Application. There was no grievance filed, the applicant disputes that a grievance was filed, and the language in the Response suggests that the applicant ought to file a grievance rather than proceed with her Application.
6As the parties have agreed to mediation, the Tribunal will schedule the Application for a half-day mediation. Details about the mediation will be issued under separate cover.

7The union filed a Request to Intervene. The Tribunal has not yet confirmed that the union is an intervenor and neither party has objected to the union being an intervenor.
8The union is added as an intervenor. It will also receive notice of the mediation.
9I am not seized with this matter.
