1On July 29, 2015, the Tribunal issued a Notice of Hearing to the parties confirming that a hearing would take place on January 21 and 22, 2016 commencing at 9:30 a.m. The Notice, which contained instructions on where the hearing would take place, was delivered to Eric Letts, counsel for the applicant, at the address provided to the Tribunal and was not returned as undeliverable.
2The applicant did not comply with Rules 16 and 17 (disclosure of documents and witness statements) in accordance with the directions contained in the Notice of Hearing. However, the applicant was served by the respondent with a witness statement for the hearing on December 7, 2016.
3I am satisfied that the applicant had notice of the time and place of the hearing.
4The respondent was in attendance at 9:30 a.m. Neither the applicant nor his counsel, were in attendance at that time. In accordance with its usual practice, the Tribunal waited 30 minutes before proceeding.
5At 10:00 a.m. the applicant was not in attendance. I am satisfied that the applicant has abandoned this Application.
6Accordingly, the Application is dismissed.
