1On January 23, 2015, the Tribunal issued Interim Decision 2015 HRTO 109. In that Decision, the Tribunal directed that a hearing would be scheduled to determine various issues, including whether the Application should be dismissed for delay and whether the proceeding before Arbitrator Starkman appropriately dealt with the substance of the Application.

2In February 2015, the respondent City of Ottawa advised the Tribunal that the applicant had died in a tragic accident. The Tribunal sent a letter to the applicant's estate asking whether the Application would be continued. On March 13, 2015, the Tribunal received an email from Shawn Charland indicating that he was in contact with the Office of the Public Guardian to clarify how the applicant's estate and affairs would be dealt with. He asked that the Application be held in abeyance.

3On May 12, 2015, the Tribunal issued a Case Assessment Direction advising that if the Tribunal has not received any communication from or on behalf of the applicant's estate by June 26, 2015, the Application will be deemed to have been abandoned.

4The Tribunal has received no further communication.

5The Application is dismissed as abandoned.
