1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of age.
2On September 19, 2011, the Tribunal deferred this Application pending completion of a related proceeding with the Canadian Human Rights Commission (“CHRC”). See Bova v. Akwesasne Mohawk Police Service, 2011 HRTO 1722. The Tribunal has periodically requested that the applicant advise of the status of the proceeding before the CHRC, to which his counsel has responded. On June 4, 2015, the Tribunal sent the applicant and his counsel another letter requesting a status update. The Tribunal directed the applicant to advise of the status of the matter before the CHRC by July 3, 2015.
3The letter warned the applicant that if he did not respond as directed then the Tribunal may consider the failure to respond as an abandonment of the Application and dismiss it for that reason. As of the date of this Decision, neither the applicant nor his counsel has responded to the request for a status update. In these circumstances, it appears the applicant has abandoned the Application.
4The Application is dismissed as abandoned
