Introduction
1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2The respondent has filed a Request for Order During Proceedings (RFOP) in which it seeks dismissal of the matter "pursuant to Rule 19 of the Tribunal's Rules of Procedure on the basis that the Application has no reasonable prospect of success and does not set out a prima facie case of discrimination" under the Code.
3The applicant has not filed a Response to the respondent's RFOP and the time for doing so has now passed.
4The Tribunal declines to schedule a summary hearing pursuant to Rule 19A of the Tribunal's Rules of Procedure and the respondent's request that the Application be dismissed as having no reasonable prospect of success is dismissed.
5Additionally, the respondent's request for dismissal of the Application on the basis that it does not set out a prima facie case of discrimination on a prohibited ground under the Code is dismissed at this time.
6The matter will proceed in the Tribunal's process.
7I am not seized.
