1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). On April 22, 2015, the respondents filed a Form 2 - Response seeking the dismissal of the Application on the basis that since the corporate respondent is a federally-regulated entity the subject-matter of the Application does not fall within the jurisdiction of the Tribunal.
2On April 30, 2015 the Tribunal directed the applicant to file submissions on the jurisdictional issue raised by the respondents by no later than May 14, 2015. The applicant was advised that a failure to respond could be considered an abandonment of the Application and it might be dismissed for that reason.
3The applicant has not filed submissions as directed and the time for doing so has long passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
