1This Application alleges discrimination with respect to issues between the owner of a condominium unit and the building property manager contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2After reviewing the Application, the Tribunal asked the applicant to clarify who she wished to name as a respondent to the Application and also to clarify the nature of the allegations and how they relate to the Code. As well, it appeared that some of the allegations concerned events that happened more than one year before the Application was filed and the Code provides that an Application must be filed within one year of the alleged events unless there is a good faith explanation for the delay.

3The applicant provided submissions in response to the Tribunal’s request for these clarifications. The applicant advised that the only respondent is the building property manager and the Application relates to a dispute about a repair to the outside wall of the building.

4The Code does not cover all allegations of unfair treatment. It only covers discrimination and harassment in respect of specified areas and grounds. It is apparent that the dispute, in this case, is not a dispute that this Tribunal has jurisdiction to deal with as it does not raise any allegation of discrimination contrary to the Code.

5The Application mentioned an earlier episode that might have raised a Code-related issue but the applicant agrees that this happened more than one year before the Application was filed and indicates that on that basis she is not pursuing it.

6In these circumstances, the Application is dismissed on the grounds that it does not involve anything that this Tribunal has jurisdiction to deal with.
