1This Application alleges discrimination with respect to employment because of marital status contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The respondent has filed a Response denying the allegations.
2The hearing is scheduled to commence on September 8 and 9, 2015 pursuant to the Notice of Hearing dated March 24, 2015 (“the Notice”).
3The respondent filed a Request for Order During Proceedings (“RFOP”) seeking the names and addresses of the applicant’s spouse and relative/friend who were present during a meeting on March 14, 2014 (“the information request”). The applicant filed a Response to the RFOP opposing the information request on the basis that it was premature, is irrelevant to the merits of the Application, and that such information could be already obtained by the respondent.
analysis
4The respondent’s information request is denied as it is premature.
5Rule 17 of the Tribunal’s Rules of Procedure sets out rules for the identification of witnesses prior to a hearing, including the filing of witness statements of a witness’ intended evidence. According to the Notice, the parties have to file their respective witness information, including identification of their witnesses, by July 27, 2015. Accordingly, the respondent’s request at this stage is denied as premature.
6In reviewing the pleadings, the Tribunal notes that the applicant has filed a substantial Reply, in which she submits that she amends her Application to include new Code grounds beyond that marked off on her Application. The Tribunal reminds the parties that the amendments of the pleadings requires the consent of the Tribunal and if the applicant is seeking to amend her Application to include new Code grounds, or new allegations, she is to file with the Tribunal a RFOP herself, marking off the box requesting to amend the Application, and setting out the remainder of the RFOP as required.
7I am not seized with this matter.
Dated at Toronto, this 16^th^ day of June, 2015.
