DECISION
Adjudicator: Naomi Overend
Indexed as: Balloi v. Human Rights Tribunal of Ontario
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on January 3, 2012, which was deferred on consent on February 22, 2012.
2On April 24, 2014, the applicant contacted the Tribunal by telephone inquiring about the status of this case and was advised by correspondence that day that if she wished to reactivate this Application she must file a Request for an Order During Proceedings. The applicant did not file the reactivation Request and so on July 18, 2014 the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to file her Request to reactivate within 14 days, failing which her Application may be dismissed as abandoned.
3The applicant has not responded to the CAD and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 20th day of January, 2015.
