1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2The Application as filed lists the personal respondent as the sole respondent. Together with the Response (Form 2), Legal Counsel for the personal respondent filed a Request to Intervene (Form 5) seeking to add the organizational respondent. The personal respondent is employed by the organizational respondent. The applicant did not object to this request in her Reply (Form 3). In these circumstances, the Application is amended to add York Catholic School Board as a respondent. The style of cause has been amended to reflect this change.
3The Response also makes a number of other requests of the Tribunal, including: removal of the personal respondent; a finding that some of the allegations in the Application ought to be removed due to delay; and a finding that there is no reasonable prospect that the applicant will be able to produce evidence that establishes a link between the described events and her disability. The applicant addressed these issues in her Reply
4Both parties have indicated an interest in mediation. The Tribunal shall therefore schedule a mediation session. Further information about the mediation will be provided under separate cover.
5If no settlement is reached, the Tribunal will consider outstanding Requests for Orders. The Tribunal may issue directions or request further submissions, where appropriate.
