1This is an Application filed under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment on the basis of sex, including sexual harassment and sexual solicitation and advances. The individual whom the applicant alleges sexually harassed and sexually solicited her has not been named as a personal respondent.
2The respondent has filed a Response denying the allegations against it.
3In Interim Decision, 2015 HRTO 226, the Tribunal deferred the Application pending conclusion of an individual's criminal proceedings and the WSIB's psychological assessment of the applicant.
4On March 16, 2015, the applicant filed a Request for Order During Proceedings ("RFOP") seeking re-activation of her Application. She submits that the WSIB process has concluded, with the applicant being approved to attend retraining, which she has started. She submits that the criminal proceedings have concluded. She provided a copy of correspondence from WSIB in relation to her Work Transition plan and correspondence from Ministry of Community Safety and Correctional Services in relation to the disposition of the criminal charges against the individual named in her Application.
5The respondent has not filed a Response to the RFOP and the time for doing so has elapsed.
6In these circumstances, the applicant's request to re-activate is granted. Since the parties have agreed to mediation, the Tribunal will schedule a mediation date. The parties will be advised of the mediation date under separate cover.
7I am not seized with this matter.
