HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Tyler Archer Applicant
-and-
FirstOntario Credit Union Limited Respondent
DECISION
Adjudicator: Alison Renton Date: June 10, 2015 Citation: 2015 HRTO 769 Indexed as: Archer v. FirstOntario Credit Union Limited
1This Application alleges discrimination with respect to contracts because of age contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2A Notice of Hearing was issued dated January 13, 2015, scheduling a hearing for June 22, 2015 ("the Notice"). The Notice set out the parties' disclosure obligations under Rules 16 and 17 of the Tribunal's Rules of Procedure ("the Rules").
3A Case Assessment Direction ("the CAD") was issued on May 19, 2015, as the applicant had not complied with his disclosure obligations as set out in the Notice. The Tribunal, in the CAD, directed the applicant to comply with his disclosure obligations by May 29, 2015, and warned that if he did not comply, his Application may be dismissed as abandoned.
4The applicant did not comply with the directions set out in the CAD or otherwise communicate with the Tribunal.
5On June 3, 2015, the Tribunal sent a Registrar's letter to the applicant directing the applicant to comply with his disclosure obligations by June 8, 2015, and warning that his Application would be dismissed if he did not comply with the direction. The Registrar's letter was sent to the applicant's alternate contact, and the applicant himself, by email.
6Since the issuance of the Registrar's letter, the applicant has not complied with the Tribunal's directions or otherwise communicated with the Tribunal.
7In light of the applicant's failure to comply with the directions in the Notice, the CAD and the Registrar's letter, the Tribunal dismisses the Application as abandoned and the June 22, 2015 hearing date is cancelled.
Dated at Toronto, this 10th day of June, 2015.
