DECISION
Adjudicator: Naomi Overend Date: May 29, 2015 Citation: 2015 HRTO 710 Indexed as: Attal v. Target Canada
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on September 22, 2014.
2On March 25, 2015, the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to advise the Tribunal and the other parties within 60 days whether she intends to take steps to lift the court-ordered stay or otherwise make an agreement with the Target Canada Entities or Monitor.
3The applicant was warned that if the applicant failed to advise the Tribunal and other parties by the required deadline, the Tribunal might consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not responded to the CAD and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 29th day of May, 2015.
