1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. This Application was deferred by the Tribunal on November 20, 2014 pending the completion of the Ontario Labour Relations Board proceeding.

2On February 9, 2015 the Employment Standards Officer issued her decision. Although the applicant did not file a Form 10 Request to reactivate the Application, on February 11, 2015 she advised the Tribunal by email that the Ontario Labour Relations Board (“OLRB”) proceeding was complete. She attached a copy of the OLRB decision and asked that her Application be reactivated.

3The applicant was directed by the Tribunal to serve and file a Form 10. The applicant served the respondent and filed with the Tribunal a Form 10. The respondent has not filed a Form 11 Response to the applicant’s Request to reactivate.

4Having reviewed the matter, I find that the OLRB proceeding is concluded and that it is appropriate for the Tribunal to reactivate the Application. The Tribunal will continue to process the Application.

5The respondent is directed to deliver and file its Response to the Application within 35 days of receiving this Interim Decision.

ORDER

6The Tribunal makes the following Orders:

a. This Application is reactivated.

b. Within 35 days of the date of receiving this Interim Decision, the respondent shall file its Response (Form 2) to the Application with the Tribunal.
