1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Application was deferred by the Tribunal on March 23, 2015, pending the conclusion of the applicant’s appeal to the Ontario Secondary School Teachers’ Federation (the “Union”) and the possible grievance arising from the appeal. See 2015 HRTO 359.
2The applicant has served the respondents and filed with the Tribunal a Form 10 Request to reactivate the Application.
3The respondents have not filed a Form 11 Response to the applicant’s Request to reactivate.
4At the time of writing the March 23, 2015 deferral decision, the Tribunal was not aware of the fact that the applicant’s appeal of the Union’s decision to withdraw his grievance had been determined. The applicant’s Form 10 included a letter from the Union which indicated that the Union had denied the applicant’s appeal and a letter from the Union to the respondent indicating that the Union would not be proceeding with the applicant’s grievance.
5Having reviewed the matter, I find that the applicant’s grievance is no longer proceeding. It is appropriate for the Tribunal to reactivate the Application. The Tribunal will continue to process the Application.
6The respondents are directed to deliver and file their Responses to the Application within 35 days of receiving this interim decision.
ORDER
7The Tribunal makes the following Orders:
a. This Application is reactivated.
b. Within 35 days of the date of receiving this Interim Decision, the respondents shall file their Response(s) (Form 2) to the Application with the Tribunal.
8I am not seized.
