1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision addresses the personal respondent’s request for an extension of time to file a Response.
2The respondents initially requested an extension of time to file their responses to May 9, 2015. This request was granted and the organizational respondent filed its Response in due course. The personal respondent has not yet responded to the Application. She now seeks a further extension until August 31, 2015.
3The personal respondent indicates that she requires the further extension in time because of “a personal and family situation” which left her unable to file a Response by May 9, 2015. She claims that “[t]he search for a suitable senior’s residence, appropriate medical care following a health crisis, pacing (sic) a moving of a residence and relocating an elderly parent, all out of province, and my sole responsibility, has been priority over any other responsibilities.”
4The applicant claims that she understands and empathizes with the personal respondent’s situation but nevertheless opposes the request.
5I am not satisfied that an extension until August 31, 2015 to file a Response is required to ensure a fair opportunity to the personal respondent to respond to the allegations the applicant has made.
6In order to ensure the fair, just and expeditious adjudication of this application the Tribunal directs the personal respondent to deliver and file her Response (Form 2) within 35 days of the date of this Interim Decision.
7I am not seized of this matter.
