1On November 24, 2014, the Registrar issued a letter which deferred the Application. It should be noted that the deferral was requested by the applicant and unopposed by the respondent.
2The applicant filed a Request for an Order During Proceeding on April 2, 2015 seeking that the Tribunal reactivate the Application and that the Application also be amended. The respondent has not responded to the applicant’s Request and the time for doing so has long passed.
Reactivation of the Application
3The applicant has provided to the Tribunal a decision dated March 30, 2015 from an Appeals Resolution Officer at the Workplace Safety and Insurance Board.
4Having reviewed this matter I am satisfied that the other proceeding is concluded and that the Application should be reactivated. The Tribunal shall continue to process the Application.
Request to amend
5The applicant seeks to amend the Application to include additional allegations of discrimination and to increase the monetary damages sought.
6Rule 1.7. of the Tribunal’s Rules of Procedure states:
In order to provide for a fair, just and expedition resolution of any matter before it the Tribunal may:
c) allow any filing to be amended.
7I find that it is appropriate to grant the applicant’s Request to amend. The amendment of the Application is brought in a timely manner, will not delay the proceedings or prejudice the respondent since it has not yet filed its Response. Further, the Request to amend is unopposed.
ORDER
8The Tribunal orders that:
a. The Application is reactivated;
b. The applicant’s Request to amend is granted;
c. Within 35 days of the date of this Interim Decision the respondent must file a detailed Form 2, Response which responds to the amended Application.
9I am not seized.
