Adjudicator: David Muir Date: April 24, 2015 Citation: 2015 HRTO 528 Indexed as: Glemnitz v. Splashworks.com Inc.
The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
On October 10, 2013 the Tribunal issued a Notice of Intent to Defer this Application pending the resolution of another legal proceeding. In the Application, the applicant requested that Tribunal defer the Application and the parties to the Application did not object to the proposed deferral. On December 4, 2013 the Tribunal wrote to the parties to confirm that the Application would be deferred without objection.
On March 4,, 2015 the Tribunal wrote to the applicant. The applicant was asked to inform the Registrar in writing within 30 days of the date of the letter whether the other proceedings remained ongoing and, if possible, to indicate when they were expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned.
The applicant has not responded to the Tribunal's March 4, 2015 letter. The Tribunal's letter to the applicant sent by both email and regular mail has not been returned as undeliverable.
In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
