Introduction

1This Application alleges discrimination with respect to employment because of sex contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2A hearing was scheduled to begin at 10:00 a.m. on April 10, 2015 further to a Notice of Hearing (“Notice”) dated January 8, 2015. By 10:30 a.m., no party had appeared.

3The Tribunal mailed and e-mailed the Notice to the applicant and respondent at the addresses they provided in their Application and Response, respectively. The Notice advised the parties that the hearing was to begin at 10:00 a.m. on April 10, 2015. The Notice mailed to the applicant was not returned to the Tribunal as undeliverable. While the Notice of Hearing mailed to the respondent was returned as undeliverable, the e-mail to the respondent was not returned. The Tribunal has not heard from the applicant or respondents about any change in contact information. The Notice stated that failure to attend the hearing would have consequences. These include that the Tribunal might dismiss the Application as abandoned if the applicant fails to attend.

4The Tribunal also delivered to the applicant a Case Assessment Direction (“CAD”), dated March 26, 2015 with respect to the respondent’s possible bankruptcy. The CAD advised the applicant that if the Tribunal did not hear from the applicant, the hearing would proceed as scheduled. The Tribunal did not hear from the applicant.

5I am satisfied that the applicant was sent the Notice of the April 10, 2015 hearing, and there is no indication that she did not receive it or the March 26, 2015 CAD.

6In these circumstances, the Application is dismissed as abandoned.
