Introduction
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on July 25, 2014.
2On January 28, 2015, the Tribunal issued a Notice of Confirmation of Hearing to the parties confirming that the Application would be dealt with on April 17, 2015 commencing at 1:30 p.m. by telephone conference call hearing. The Notice was delivered to the applicant’s representative, a Community Legal Worker with Durham Community Legal Clinic.
3On March 16, 2015, the Tribunal received a fax from the applicant's representative, advising that he was no longer representing the applicant. It is assumed that the applicant’s representative advised the applicant of the Notice of Hearing and that the applicant therefore had notice of the hearing.
4The applicant did not call into the scheduled hearing at 1:30 p.m. By 2:00 p.m. the applicant had not called in or communicated with the Tribunal to explain the failure to call into the hearing.
5In the circumstances, the Application is dismissed on the basis that the applicant is deemed to have abandoned the Application.
