Human Rights Tribunal of Ontario
B E T W E E N:
Shagufta Tahir Applicant
-and-
City of Toronto Respondent
DECISION
Adjudicator: Naomi Overend Date: April 20, 2015 Citation: 2015 HRTO 494 Indexed as: Tahir v. Toronto (City)
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 4, 2013.
2By Interim Decision dated April 10, 2014, the Tribunal deferred proceeding with this Application pending the conclusion of ongoing grievance proceedings.
3On January 12, 2015 the Tribunal wrote to the applicant. The applicant was asked to inform the Registrar in writing within 30 days of the date of the letter whether the other proceedings remained ongoing and, if possible, to indicate when they were expected to be completed. The letter went on to warn the applicant that failure to provide the requested information might result in the Tribunal dismissing the Application as abandoned.
4The applicant did not respond to the Tribunal’s letter, and so a follow-up email was sent to the applicant on March 16, 2015, requiring the applicant to respond by March 20 2015, and again advising the applicant that if she failed to do so, the Application may be dismissed as abandoned. The applicant has not responded to the Tribunal’s correspondence and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 20th day of April, 2015.
