1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2This Application was deferred pending the conclusion of another legal proceeding in Interim Decision 2013 HRTO 2027, issued on December 6, 2013.
3On March 23, 2015, the Tribunal wrote to the parties requesting that the applicant update the Tribunal about the status of the other proceeding. The letter further advised the applicant that if he did not provide an update on the status of the other proceeding within 30 days, the Application may be dismissed as abandoned.
4The applicant did not respond to this Direction.
5On March 25, 2015, the respondent filed a Request for Order During Proceeding (Requests) seeking the dismissal of the Application on the basis that the parties had entered into Minutes of Settlement executed on various dates in April 2014 which provided, amongst other things, that the applicant would withdraw this Application. A copy of the executed Minutes of Settlement was attached to the Request. The applicant did not respond to this Request and the time for doing so has passed.
[6] In all of the circumstances, I find that the applicant has abandoned the Application and accordingly it is dismissed.
