DECISION
Adjudicator: David Muir
Indexed As: Simon v. Red Cross Partners
1This is an Application filed under section 45.9(3) of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging breach of settlement.
2The respondents have filed a Response to the Application asserting that the dispute between the parties had been resolved.
3On February 18, 2015, the Tribunal wrote to the parties asking the applicant to confirm, in light of the respondents’ Response, whether she agreed with the respondents that her concern had been addressed and if she intended to proceed with the Application. The applicant was asked to respond by March 4, 2015.
4The applicant did not respond to this correspondence from the Tribunal.
5On March 30, 2015, the Tribunal wrote to the applicant, reminding her of the February 18, 2015 correspondence and directing that she respond to it by April 7, 2015, failing which the Application may be dismissed as abandoned.
6The applicant has not responded to these Directions and the time for doing so has passed.
7In all of the circumstances I find that the applicant has abandoned this Application and it is dismissed.
Dated at Toronto, this 14th day of April, 2015.
