1On December 31, 2014, the Tribunal issued a Case Assessment Direction which was followed on January 20, 2015 by a Notice of Summary Hearing. The Notice confirmed that a summary hearing by teleconference would take place on March 24, 2015, commencing at 1:30 p.m.
2The Notice, which contained instructions on how to join the conference call, was delivered to the applicant at the last address provided by the applicant to the Tribunal and was not returned as undeliverable. I am satisfied that the applicant had notice of the hearing.
3The respondent was in attendance on the call at 1:30 p.m. The applicant was not in attendance at that time. In accordance with its usual practice, the Tribunal waited for 30 minutes before proceeding.
4At 2:00 p.m. the applicant was not in attendance. The applicant has not communicated with the Tribunal to explain the failure to attend.
5In the circumstances, the applicant was deemed to have abandoned the Application.
6Accordingly, the Application is dismissed.
