DECISION
Adjudicator: David Muir Date: March 30, 2015 Citation: 2015 HRTO 411 Indexed As: Biedermann v. Children’s Aid Society of the Regional Municipality of Waterloo
1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On December 3, 2014, the Tribunal wrote to the applicant delivering the respondents’ Response, Request to Defer, and a Notice of Intent to Defer. The applicant was directed to respond to the dismissal and deferral issues raised by the respondents. The letter further advised the applicant that if she did not reply as directed the Application may be dismissed as abandoned.
3On March 10, 2015, the Tribunal wrote to the applicant to remind her of this earlier Direction and further directed that the applicant respond by no later than March 25, 2015, or her Application may be dismissed as abandoned.
4The applicant has not responded to these Directions and the time for doing so has passed.
5The filing of an Application commences a legal proceeding which engages significant public and private resources. It is the Tribunal’s expectation that the parties to an Application will participate in the process. This includes responding to issues raised by the other parties in the proceeding and to Directions made by the Tribunal from time to time.
6In all of the circumstances, I find that the applicant has abandoned this Application and it is dismissed.
Dated at Toronto, this 30th day of March, 2015.
