1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on Apriil 17, 2014 and the respondent filed a Response on June 27, 2014.
2Mediation was scheduled for January 14, 2015 and a notice of this mediation date was sent to both parties. The notice was emailed to the applicant as correspondence sent by mail had been returned to the Tribunal. The applicant had provided his email address to the Tribunal in his Application. The email sent to the address provided did not bounce back and was delivered successfully.
3The Applicant did not attend the mediation on January 14, 2015. The applicant has had no further contact with the Tribunal.
4By email sent January 27, 2015, the Tribunal advised the applicant that he must advise the Tribunal and the respondent in writing by February 6, 2015 whether he intends to proceed with the Application. The Tribunal also advised the applicant that if he did not respond by February 6, 2015, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal’s correspondence nor has he communicated with the Tribunal in any manner.
5In these circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
