HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Lori Anne Phillpotts-de Lisser Applicant
-and-
International Automotive Group – Mid-Toronto Mitsubishi and Victor Khitrov Respondents
DECISION
Adjudicator: Naomi Overend Date: March 25, 2015 Citation: 2015 HRTO 388 Indexed as: Phillpotts-de Lisser v. International Automotive Group – Mid-Toronto Mitsubishi
Introduction
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on October 9, 2014.
2On December 8, 2014 the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) on the basis that the Application appears to be outside the Tribunal’s power to decide. The applicant was directed to respond to the issues raised in the NOID by no later than January 21, 2015. A follow-up email was sent to the applicant on February 17, 2015 directing her to provide written submissions by March 4, 2015.
3Both the NOID and the follow-up email advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason. The applicant has not responded to the NOID or the follow-up email and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 25^th^ day of March, 2015.
