1This Interim Decision concerns the request by Her Majesty the Queen in Right of Ontario as Represented by the Ministry of Education for dismissal of the Application against the Ministry.
2The Application alleges discrimination of a child in school by the School and the School Board on the grounds of disability. The Application also named the Ministry of Education as a respondent. The Ministry filed a Request for Order During Proceedings asking that the Applicant against the Ministry be dismissed. The Ministry pointed out that while it does provide funding for special education programs, it is not involved in the operation of the programs as they affect a particular student. The Ministry noted that there are no allegations about the Ministry in the Application.
3The applicant asked for additional time to respond to the Ministry’s request and he was given until March 9, 2015. Since the time of his request for more time, the Tribunal has not received a response to the Ministry’s request or any other communication from the applicant.
DECISION
4The request to dismiss the Application as against Her Majesty the Queen in Right of Ontario as Represented by the Ministry of Education is granted. The Application makes no allegation of discrimination by the Ministry of Education and there is no indication that the Ministry had anything to do with the alleged events that gave rise to the Application.
