DECISION
Adjudicator: Dawn J. Kershaw Date: March 18, 2015 Citation: 2015 HRTO 345 Indexed as: Kabala v. Maple Leaf Foods
WRITTEN SUBMISSIONS
Kasirye Kabala, Applicant Self-represented
Introduction
1This Application, filed on December 29, 2014, alleges discrimination with respect to employment and goods, services and facilities because of colour, ancestry, place of origin, ethnic origin and disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On January 7, 2015, the Tribunal issued a Notice of Intent to Dismiss the Application (“NOID”) and directed the applicant to respond to the issues identified by no later than February 6, 2015.
3The NOID states that the Application appears to be outside the Tribunal’s jurisdiction because:
- while your response to question #7 of the Application alleges that the last incident of discrimination you experienced occurred on June 12, 2014, a review of your Application indicates that it is either not clear what incident of discrimination is alleged to have occurred on this date or how the incident described as occurring on that date constitutes an incident of discrimination within the meaning of the Code. See for example Miller v. Prudential Lifestyles Real Estate, 2009 HRTO 1241; Mafinezam v. University of Toronto, 2010 HRTO 1495; and [Garrie v. Janus Joan Inc., 2012 HRTO 1955](https://www.minicounsel.ca/hrto/2012/1955
