1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of disability.
2On December 22, 2014, the Tribunal issued a Case Assessment Direction (“CAD”) advising the parties that a summary hearing would be held by teleconference. The parties were also provided with instructions on how to prepare for and participate in the summary hearing.
3On January 21, 2015, the Tribunal issued a Notice of Confirmation of Hearing indicating that the summary hearing would take place on March 6, 2015 by teleconference at 1:30 p.m. The Notice provided the parties with instructions on how to dial into the teleconference. The Notice was sent by regular mail to the last address provided by the applicant.
4When the summary hearing commenced at the scheduled time, the respondent was in attendance, however, the applicant was not. Consistent with the Tribunal’s practice, I waited thirty minutes for the applicant to join the call.
5The applicant did not join the call and in all of the circumstances, I am satisfied that the applicant has abandoned this Application.
6Accordingly, the Application is dismissed.
