1This Application alleges discrimination with respect to disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On April 7, 2014, the Registrar, in light of the consent of the applicant and the Workplace Safety and Insurance Board (“WSIB”), sent a letter to the parties advising that the Application was being deferred pending the completion of appeals at the WSIB.
3On December 9, 2014, the applicant made a Request to reactivate the Application. The respondent WSIB opposed reactivation because the WSIB proceedings had not been concluded. On January 16, 2015, the Tribunal issued Interim Decision 2015 HRTO 67 in which the applicant’s Request to reactivate was denied.
4On January 28, 2015, the applicant filed a second Request to reactivate the Application. Neither of the respondents filed submissions in response to this request and the time for doing so has passed.
5Having considered the applicant’s submissions, I am satisfied that the other proceeding is concluded. Therefore, the Tribunal will reactivate the Application.
ORDER
6The Tribunal orders that:
a. The Application is reactivated; and
b. Within 35 days of the date of this Interim Decision, the respondents must deliver to the Tribunal their Form 2, Response to the Application.
7I am not seized.
