Applicant

Good News Christian Community
Respondent
DECISION
Adjudicator: Brian Eyolfson
Indexed as: Earhart v. Good News Christian Community
1This Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on March 27, 2014.
2On November 21, 2014, the Tribunal forwarded correspondence to the applicant from a trustee in bankruptcy indicating that the respondent was engaged in bankruptcy proceedings.
3By letter dated November 25, 2014, the Tribunal directed the applicant to confirm whether he intended to proceed with the Application, within 14 days of the date of the letter. The Tribunal’s letter advised the applicant that if he did not confirm his intention to proceed with the Application within 14 days of the date of the letter, the Tribunal may consider the failure to respond as an abandonment of the Application, and the Tribunal may dismiss the Application for that reason.
4As of the date of this Decision, the applicant has not responded to the Tribunal’s November 25, 2014 letter, nor does it appear that he has otherwise communicated with the Tribunal since August 20, 2014. The Tribunal’s letter was delivered to the applicant at the email and mailing addresses the applicant provided in the Application, and has not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 11th day of March, 2015.
