DECISION
Adjudicator: Naomi Overend Decision Date: March 11, 2015 Citation: 2015 HRTO 296 Indexed as: Khawaja v. Silfab Solar Inc.
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"), on July 31, 2014.
2On January 21, 2015, the Tribunal wrote to the applicant advising that the Tribunal's records indicated that the applicant had advised Tribunal staff that he wished to withdraw his Application, but had not yet filed a Form 9 (Withdrawal).
3The applicant was directed to provide the Tribunal with a completed Form 9 or, if did not wish to withdraw his Application, indicate whether he wished to participate in mediation. The applicant was directed to provide the Form 9 or advise the Tribunal of his interest in mediation by February 4, 2015. The letter went on to advise the applicant that if the Tribunal did not receive a response by that date, the Tribunal might dismiss the file as abandoned.
4The applicant has not responded to the Tribunal's correspondence or otherwise contacted the Tribunal, and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application. The Application is dismissed.
Dated at Toronto, this 11th day of March, 2015.
